We initiated legal proceedings for trademark and copyright infringements; We proved illegal import, storage and distribution intentions; We demanded not only to stop the infringements, but also real compensation for damages.
Result:
The courts recognized that the Client's intellectual property rights were infringed. More than 120,000 EUR in damages were awarded. Further use of the Client's trademarks and works was prohibited. Illegal goods were destroyed. The infringers were also ordered to cover litigation costs.

Eiip successfully represented a legal entity accused of copyright infringement and appropriation of authorship rights.

The Claimant sought recognition as a co-author of a publication, compensation for alleged copyright violations, unpaid remuneration, and damages.

The case involved extensive factual and legal analysis, including expert linguistic examination, witness testimony, and detailed evaluation of contractual relations between the parties.

Strategy:

We built a defence focused on precision, evidence, and strong legal positioning: Demonstrated that the Claimant's role was primarily editorial and technical, not authorship.

Proved that contractual agreements allowed lawful use of submitted materials.

Used expert linguistic analysis and detailed evidence to challenge originality and authorship claims.

Exposed the lack of proof supporting alleged damages and additional payments.

Result:

The Court fully dismissed the claim.

The Court concluded that: There was no sufficient legal or factual basis to recognise the Claimant as a co-author;

The Claimant's demands, including compensation and additional payment claims, were not proven;

The entire claim was rejected, and litigation costs were awarded in favour of the Client.

The provisions set forth in this policy apply to you to the extent that Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (the "GDPR") and Lithuania Personal Data Legal Protection Law apply to processing of your personal data.

WHAT DATA DO WE PROCESS ABOUT YOU?

Personal data means any information relating to an identified or identifiable natural person. An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

Processing means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

EiiP may collect, use, store, transfer or otherwise process different kinds of personal data about you which are as follows:

  • First name, maiden name, surname, username or similar identifier, marital status, title, date of birth and gender, home address, email address and telephone numbers, date of birth, nationality, signature, social security number and income necessary, for us to enter into an agreement for services with you or/and to provide services under the agreement to you;
  • Bank account, payment card details and credit history for taking payments from you for our services, details about payments to and from you and us;
  • First name, surname, email address, phone number, CV and motivational letter of candidates to entering into a service or employment contract with a candidate;
  • If relevant, information about your business partners, dependants or family members (such as the name of your spouse, partner, or children), representatives and agents, your job title, role and the name of your employer;
  • For corporate clients, information about directors, employees or shareholders;
  • Agreements for legal and patent attorney services, other service or employment agreements, court and other documents containing personal data;
  • Communications data containing your preferences in receiving marketing or other type of communications from us and third parties.

If you fail to provide personal data when we are required to collect this data by law or under the terms of an agreement concluded with you, we may not be able to conclude the agreement with you or to perform the agreement we have with you. In this case, we may be forced to cancel the agreement with you.

Before providing EiiP with personal data of other individuals (e.g. family members, representatives, agents, directors, employees, shareholders, etc.) you should provide a copy of this policy to those individuals.

WHERE AND HOW DO WE OBTAIN YOUR DATA?

We obtain your personal data:

  • when you provide to us any documents that you complete when entering into an agreement with EiiP. This may include information about your name, address, date of birth, passport details or other national identifier, driving licence, your national insurance or social security number or income, employment information, tax-related information;
  • when you provide personal data to us in correspondence and conversations;
  • when you make transactions with us;
  • when you provide us with information and documents in connection with the services you require from us;
  • from publicly available directories and sources;
  • from public registers (Industrial Property registers, for instance Lithuania State Patent Bureau Trademark, Patent, Design Registers, Lithuania Registry Center, etc.);
  • from court, governmental or regulatory bodies in connection with the services you require from us.

FOR WHAT PURPOSES DO WE PROCESS YOUR DATA?

We collect and process your data for several purposes and we rely on the legal bases provided below:

Entering into agreements and performing services:

In order to enter into agreements with our clients and service providers, for service provision purposes, we process the personal data of the persons authorized to sign the agreements and of the clients' and service providers' contact persons and details. The legal basis for such data processing is Article 6(1)(b) GDPR (Performance of contract) and Article 6(1)(f) GDPR (Legitimate interests, based on our interest to provide our clients and service providers with relevant information).

If you use our services, for service provision purposes, we process your name and job title, contact details, including the company you work for and email address; payment information, in case of corporate clients' or prospective clients' any information on their officers or personnel, any opponent or vendor or purchaser personal information including personal information relating to their legal advisors, other advisors or personnel; information that you provide to us as part of us providing the services to you; relevant information as required by Anti-Money Laundering and Terrorist Support Prevention regulations, other information and documents containing personal data relevant to provision of our services.

To provide legal services we may be required to collect and use sensitive personal information relating to you (e.g. data on your racial or ethnic origin, political opinions, religious beliefs, trade union activities, health, sexual life or sexual orientation, details of criminal offences, genetic or biometric data). For instance, in some employment representations information about medical conditions, religion, etc. may be relevant to the representation. When personal sensitive information is processed by us in relation to this and other similar legal services, this will be done to assist the client to establish, exercise or defend legal claims or to assist the client in fulfilling the rights and obligations under the applicable laws.

The legal basis for such data processing is Article 6(1)(b) GDPR (Performance of contract), and Article 6(1)(c) and/or (f)GDPR (Legitimate interests, based on our interest to provide the clients with our services and third parties' legitimate interest to establish, exercise and defend their rights and to fulfil their rights and obligations under the applicable laws).

Applying for a job:

In case applicants apply for a job we process the applicants' personal data (first name and surname, e-mail address, phone number, curriculum vitae (CV), cover letter, salary expectations, availability, previous employer, certificates, recommendations, etc.) exclusively in order to decide on the establishment of an employment or service relationship, and, if so, in order to perform and terminate such a relationship. The legal basis for such data processing is Article 88 GDPR and Article 5 of Lithuania Personal Data Legal Protection Law.

Contacting by e-mail, telephone, other means of electronic communication or in writing:

If you send us inquiries by e-mail, telephone, other means of electronic communication or in writing, we process the information provided therein, including the contact details you have provided for the processing of the inquiry. Such data is also stored with us for possible further inquiries. The legal basis for this is Article 6(1)(b) GDPR (Performance of contract – the processing of the user's data is necessary for the performance of the contract regarding the reply to inquiries) and Article 6(1)(f) GDPR (Legitimate interests – based on our interest to process inquiries of our clients and service providers).

HOW DO WE PROTECT YOUR DATA?

This website is hosted on servers in the EEA.

EiiP employs appropriate technical, security and organisational measures to prevent unauthorised or unlawful access to the personal data EiiP holds.

However, as complete data security cannot be guaranteed for communication via e-mails or similar means, we would recommend you sending any particularly confidential information to EiiP by alternative secure means.

Further, as the transmission of information via the Internet is not completely secure, we cannot accept responsibility for the security of your personal data when in transit over the Internet to EiiP.

WHAT RIGHTS DO YOU HAVE?

You have the following rights in relation to personal data protection:

  • the right to access your personal data;
  • the right to receive personal data we hold about you in a structured, commonly used and machine readable format;
  • the right to restrict the use of your personal data;
  • the right to have incomplete or inaccurate personal data corrected;
  • the right to ask us to stop processing your personal data for marketing purposes or for any other processing carried out on the basis of our legitimate interest where such legitimate interests are overridden by your interests or fundamental rights and freedoms;
  • the right to require us to delete your personal data in some limited circumstances;

HOW LONG DO WE KEEP YOUR DATA?

We keep your personal data for as long as it is required by us for our legitimate interest, to perform our contractual obligations, or as long as it is required by applicable law or regulations.

We will generally retain personal data about you throughout the duration of our contractual relationship. Certain personal data will be retained after your legal relationship with us ends for a period of 10 years thereafter where necessary to comply with applicable laws and regulations or to establish, exercise or defend actual or potential legal claims, subject to the applicable statutes of limitation, unless a longer period is required by applicable laws and regulations.

Upon expiry of the applicable retention period we will destroy your personal data in accordance with applicable laws and regulations.

DO WE TRANSFER YOUR DATA OUTSIDE THE EEA?

We transfer your personal data to third parties outside the EEA only if this is necessary to fulfil the contractual obligations, if we or the third party have a legitimate interest in the transfer or if you have consented to the transfer.

We transfer personal data to third parties based in non EEA countries only if the recipient either has an adequate level of data protection (e.g. based on an EU Commission adequacy decision for the country in question, the agreement of so-called EU standard contractual clauses of the European Union, etc.) or has obtained consent from our clients prior to disclosure.

In addition, we may transfer personal data to third parties insofar as we are obliged to do so by law or by court order or if the transfer is necessary for the establishment, exercise or defence of legal claims.
