TRADEMARKS

The Client's trademarks and copyrighted works were used without permission – infringing goods were imported into Lithuania and prepared for distribution.

Competitors tried to earn money from the Client's intellectual property.

Strategy:
We initiated legal proceedings for trademark and copyright infringements; We proved illegal import, storage and distribution intentions; We demanded not only to stop the infringements, but also real compensation for damages.
Result:
The courts recognized that the Client's intellectual property rights were infringed. More than 120,000 EUR in damages were awarded. Further use of the Client's trademarks and works was prohibited. Illegal goods were destroyed. The infringers were also ordered to cover litigation costs.

Successful defence in copyright and co-authorship dispute
✓ Case won

Eiip successfully represented a legal entity accused of copyright infringement and appropriation of authorship rights.

The Claimant sought recognition as a co-author of a publication, compensation for alleged copyright violations, unpaid remuneration, and damages.

The case involved extensive factual and legal analysis, including expert linguistic examination, witness testimony, and detailed evaluation of contractual relations between the parties.

Strategy:

We built a defence focused on precision, evidence, and strong legal positioning: Demonstrated that the Claimant's role was primarily editorial and technical, not authorship.

Proved that contractual agreements allowed lawful use of submitted materials.

Used expert linguistic analysis and detailed evidence to challenge originality and authorship claims.

Exposed the lack of proof supporting alleged damages and additional payments.

Result:

The Court fully dismissed the claim.

The Court concluded that: There was no sufficient legal or factual basis to recognise the Claimant as a co-author;

The Claimant's demands, including compensation and additional payment claims, were not proven;

The entire claim was rejected, and litigation costs were awarded in favour of the Client.

Eiip represented a well-known Lithuanian confectionery company in a dispute over an EU trademark. EUIPO completely rejected the opponent's opposition.

We demonstrated the marks are visually and phonetically not very similar and conceptually different, despite identical services.

The Client has retained its trademark.

Civil proceedings (two claims filed); Criminal complaint to law enforcement; Regulatory action with Lithuanian consumer protection authorities; Negotiation track conducted in parallel.
Result:
